During the arguments upon application under Order VII rule 11 CPC, it is surfaced that the Defendant No.1 Mst. Sumera Nasreen already died. The present Counsel filed his Vakalatnama and written statement and in hand application under Order VII rule 11 CPC through legal heirs of Defendant No.1. However, record does not show if any application under Order XXII rule 4 CPC was filed for impleading legal heirs of Defendant No.1. In such Vakalatnama, written statement and application under Order VII rule 11 CPC have been filed without any amended title of plaint. According to the Counsel for legal heirs of Defendant No.1 another Civil Suit No.2057/2024 regarding same subject matter is also pending before this Court wherein the legal heirs of deceased Defendant No.1 Mst. Sumera Nasreen have been properly impleaded and proceeding with the matter therefore, under such impression neither the Counsels of the parties nor the Court look into this inadvertent lacuna. The submission made by the Counsel for the legal heirs of Defendant No.1 requires consideration and the above lacuna is curable therefore, the Counsel for the Plaintiff now required to submit amended title of plaint by impleading legal heirs of deceased Defendant No.t Mst. Sumera Nasreen through legal heirs. Put off to 25.11.2025 for compliance and arguments on application under Order VII rule 11 CPC as well as filing of Court Fees Stamp by the Plaintiff side as last and final chance. |
