Civil Appeal under Section 96 CPC is called. Appellant No. 1(h), namely Arab, along with his learned counsel, Mr. Ch. Shahid Hussain, is present. Abdul Majeed, attorney of Respondents No. 1(a) to 1(f), along with learned counsel, Mr. Abdul Fatah Samo, is also present. Respondent No. 2, namely Shahzado, along with the Junior Partner of Mr. Muhammad Tarique, learned counsel for Respondent No. 2, is present. The official respondents are absent; however, DDA for the official respondents is present. Today, the matter is fixed for objections and hearing of the application under Section 151 CPC seeking amalgamation of the instant Civil Appeal with Civil Appeal No. 10 of 2026, Ghulam Mustafa vs. Public at Large, which is also fixed for today. Heard. Order passed on the instant application, the same has been allowed. Accordingly, Civil Appeal No. 10 of 2026, Ghulam Mustafa vs. Public at Large, is treated as the leading appeal, whereas the instant Civil Appeal No. 11 of 2026, Ghulam Mustafa vs. Gul Baharan, shall be treated as the subsequent appeal. The office is directed to keep a photocopy of the application & order passed on the application under Section 151 CPC and place the same on the file of the leading appeal. Now, the appeals are fixed for 21.10.2026 for arguments. In the meantime, the office is directed to call for the Record and Proceedings (R&Ps) from the learned Trial Court. |
