Matter called. Counsel for DH is present. JD appeared with his newly counsel namely Ashraf Ali Shah who file power and time for assist the court. Record shows that execution application already allowed vide order dated: 2.2.24 thereafter JD through his counsel submit application U/S 151 CPC for suspension of warrant the same application is allowed and direction to JD for compliance. Today arguments from both sides heard. Counsel for DH submit that execution allowed wherein JD has to submit Rs. 500000/- as off dower amount and Rs. 6000/- of daily maintenance and also to bear the house hold expenses. Counsel for JD submitted that as per the terms and condition and compromise decree pass by this court dated: 28.11.22 plaintiff rejoin the defendant till july-25 thereafter two FIRs registered against the JD so also his family which are pending before the concerned courts, he further draw the intention of this court para no. 1 of the compromise decree wherein the JD would have to pay dower amount of Rs. 500000/- within period of 4 years from date of decree which is 28.11.2022 he contended that said period has not been passed so far other terms and condition of the compromise decree plaintiff reside with JD till july-25. In last JD acknowledge that execution application has been allowed and he may be granted time to further assist this court in respect of execution application/compliance. Request of the counsel for JD is allowed. Matter put up to 08.12.2025 for compliance. |
