Today, both suits CS No. 1094/2016 (leading) and CS No. 2052/2022 (subsequent) were fixed for filing of affidavit in evidence of the plaintiff witnesses of the leading suit, Shehbaz Ahmed and Shaikh Muhammad Bilal. Despite strict directions, no one appeared for the plaintiff of the leading suit and no adjournment application was filed, whereas the respective counsel for the defendants appeared. Counsel for Defendant No. 5 in the subsequent suit, Mehboob Ahmed Khan Bohri, clarified he is not a defendant in the leading suit and drew attention to his application under Order XIV, Rule 5 CPC, filed on 19.02.2026, on which the plaintiff failed to file objections. The Court struck off the plaintiff???s right to file objections . The leading suit is adjourned for further evidence via affidavit, being the last chance for the plaintiff, and the subsequent suit is adjourned for arguments on Defendant No. 5???s application. Both suits are now fixed for 31.03.2026. |

CS No.1094/2016 (leading) and CS No.2052/2022 (subsequent) are consolidated suits and transferred to this Court. Plaintiff of leading suit absent; counsel for Defendant No.6 and also defendant No. 1 to 3 present. Plaintiff of suit No. 2052/ 2022 present. It is noted that evidence of plaintiff was already recorded and application under Order 16 Rule 1 CPC for production of witnesses (Shehbaz Ahmed & Shaikh Muhammad Bilal) was moved without objection from Defendants No.5 & 6. Order passed on separate sheet. same is allowed. Plaintiff directed to file affidavit-in-evidence of said witnesses on next date. Parties directed to proceed as per Model Court framework. Office directed to tag both suits. Matter is fixed for 25.03.2026 for filing affidavit in evidence of plaintiff's witnesses.

The titled suit, transferred to this Court as one of the oldest pending matters, was fixed today for hearing of the plaintiff???s application under Order XVI Rule 1 CPC. The counsel for the plaintiff, along with the plaintiff, appeared. Perusal of the record shows the suit is for Declaration, Cancellation of Registered Documents, Mandatory and Permanent Injunctions, and is the leading suit connected with CS No. 2052/2022 (subsequent suit). Nobody appeared for the defendants. Considering the connection with the subsequent suit, the Court observed that it would be appropriate to make a reference of the titled suit back to the Worthy District Judge Karachi East.
