Judgement passed and announced in open Court that Prosecution has well established its case extent to charge framed against all accused facing trial for offences punishable under section 452, 337A(i),337F(v),147,148,149 PPC .They are convicted?? under section 245(ii) Cr.P.C. Deriving guidelines provided in Criminal Appeal No.143/2017,Mushtaque Hussain versus The state, let the victim Barkat, Zameer and Hidayatullah be compensated through Daman/Arsh. In that regard, section 337-Y(1) Cr.P.C, further demonstrates that expenditure incurred against treatment, anguish faced and loss of functioning power of the organ be kept in mind while fixing the amount. So, observing the circumstances, accused??Ali Khan alias Khadim is convicted for the commission offence and sentenced him as following under sections 337A(i)?? PPC, to one (01) year rigorous imprisonment as ta???zir & further liable to pay Daman of Rs.10,000/- to be paid to injured namely ??Mst. Gulzar Khatoon as compensation for the expenses borne by her on her treatment or in default in payment of daman, accused will be dealt with in a manner prescribed by section 337-Y(ii) PPC. ?? Accused Muhammad Moosa is convicted for the commission offence and sentenced him as following under section 337-F(v)PPC,?? to three (03) year rigorous imprisonment & ??further liable to pay Daman of Rs10,000/- to be paid to injured Muhammad Urs?? as compensation for the expenses borne by him on his treatment or in default in payment of daman, accused will be dealt with in a manner prescribed by section 337-Y(ii)PPC. ?? Further all accused facing trial are also convicted for offenses punishable under section 452 PPC, to three years, rigorous imprisonment and also all accused are convicted for offenses punishable under section 147,148,149 PPC and are sentenced with fine amount of Rs.500/- each accused for each offense. In case of failure to pay fine amount shall remain custody three days more for each offense as simple imprisonment. All the sentences awarded to the convicted accused shall run concurrently. All accused are present on bail, they are taken into custody and are remanded in Central Prison and Correctional Facility Center, Sukkur, through jailor District Prison Ghotki, in order to serve out the sentences awarded to them, their bail bonds stand cancelled and sureties are discharged. Benefit of section 382-B Cr.P.C, is given to convicted accused if any available. Copies of judgment are provided to each convicted accused free of costs under receipt. |
