Suit called. On first call, attorney of plaintiff Muhammad Hassan was called present along with one witness Ali Akbar and junior partner of his counsel. Abdul Razaque, attorney of defendants is called present. When confronted with attorney qua his absence on previous date of hearing as well as on 08.03.2024 when he was asked to procure attendance of his witness and proceed with the matter, he chosen to leave away without any intimation. On the other hand, issues have been framed on 30.05.2024, but till time, not a single witness has been examined on behalf of plaintiff side. Nevertheless, the plaintiff was asked to be ready to proceed with the matter. Accordingly, it was kept aside, again called around 09:20 AM, 09:50 AM, and 10:30 AM, but the attorney repeated same practice, choosing to leave away along with his witness and counsel. In attending circumstances, the attitude is intolerable from every corner. None should have much courage to lay with the decorum of Court, the attorney too, should have abide the practice but he didn???t do so. Resultantly, suit of plaintiff is dismissed in default with cost of Rs.10,000/- to be deposited by the attorney. In case of failure, it shall be recovered through proceedings of law. |
