Suit called. Counsel for the parties are present. Arguments heard on the application under Order VII, Rule 11, CPC. Meanwhile, on the previous date, the counsel for the plaintiff was put on notice to satisfy the Court regarding its jurisdiction to entertain this suit. Upon hearing and perusal of the record, it is observed that the primary reliefs claimed relate to regulatory actions of the Drug Regulatory Authority of Pakistan (DRAP) concerning registration and distributorship of the pharmaceutical product ???Cecolin (HPV Vaccine),??? which are expressly barred from civil court jurisdiction under Sections 11 and 46 of the DRAP Act, 2012. Although the plaint also contains contractual claims against Defendant No. 2, these are inseparably linked to the regulatory status of the product. In view of the above, the civil court lacks jurisdiction, and the plaint is returned under Order VII, Rule 10, CPC for presentation before the competent forum, the Appellate Board under Section 11 of the DRAP Act, 2012. The plaintiff shall remain at liberty to pursue independent contractual claims before a civil court of competent jurisdiction. The interim order passed earlier on 25.09.2025 stands recalled.
