The order passed on separate sheet. During pre-trial this court has taken serious efforts for compromise/reconciliation of parties as there is no specific form is provided to conduct reconciliation proceedings between parties, however the plaintiff stated that she cannot live, as wife, with defendant, as well as, cannot observe the limits prescribed by Almighty Allah and instead of joining defendant rather to choose die. Forcing the plaintiff to pull on the marital bond in the attending circumstances, as exposed to me, does not appear productive in any manner. In the light of above facts and circumstances, the compromise /reconciliation between parties was not possible, hence the such proceedings are failed Therefore, the prayer of the plaintiff regarding the Dissolution of Marriage is allowed. As such the marriage of plaintiff with defendant stands dissolved by way of Khula in lieu of unpaid haq mahar. Let the decree be prepared for knowledge of both parties. The copy of decree also be sent to the concerned Union Council in compliance of sub-section (2) section 21 of the West Pakistan Family Court Act 1964.Adjourned to 10.8.2026 for issues. |

Today Suit is fixed for Pre-trial and compliance of order dated:28.1.2026 passed on application under section:17-A for interim maintenance. The Pre-Trial is declared as fail. Consequently I am of considered opinion that, the plaintiff has made out a good case in her favour. Resultantly, the marriage of the plaintiff with defendant stands dissolved by way of Khulla, in lieu of dower amount. I am of the opinion that plaintiff namely Mai Begum and three minors namely Ameer Hamza aged about 4 years, Zara aged about 3 years and Zunera aged about 1 year are entitled to maintenance at the rate of Rs:5,000/ per month each from date of driven out till their legal entitlement. There shall be 10 % increase annually. That as per plaint the marriage was taken place about 8 years ago and plaintiff was diven out by defendant in November 2025 and in my view articles at S.No:3,4,5,6,7,11,12,15 to 17 may be used in such period, hence plaintiff is not entitled to receive such articles however plaintiff is entitled to receive rest of dowry aricles as per list attached.
