Criminal case called. Accused Asharf is present on bail. (Accused Nanjo was declared as proclaimed offender) ADPP for state is absent, but Naib Court is present. Process returned partly served upon P.Ws. Complainant is present. At this stage accused Ashraf Mallah moved application at Exh.29 wherein he admitted his guilt. Order on application. Showcause notice was given to accused at Exh.30, as to why he convicted with imprisonment on his admission of guilt. Accused submitted reply of show cause notice at Exh.31, to which he requested for lenient view, as he is poor person. Order U/S 243 Cr.P.C passed at Exh.32, and announced in open Court. As per order by taking a lenient view accused Ashraf S/o Muhammad Mallah is convicted U/S 243 Cr.P.C for the offence U/S 379 PPC and sentence his to suffer S.I for eleven days, which he has already undergone and also to pay fine of Rs.50000/- (Five thousand rupees), in case of default of payment of fine, he shall suffer four days S.I. The benefit of section 382 Cr.P.C is given to accused. Accused is present on bail, he paid fine amount, which deposited under proper head of account in NBP Diplo branch.
