Matter called. Learned counsel for the plaintiff is present and filed statement alongwith Courier and Registered AD receipts which are kept on record. Mr.Asad Ali advocate filed undertaking to file Vakalatnama on behalf of defendant No.2 which is kept on record and received copies. None is present from the defendant No.1. Process through Bailiff returned served upon defendant No.1. The service is held good upon defendants. Order passed on separate order sheet. Therefore, the defendants are restrained from cancellation of the unit of plaintiff and or allotting the said unit to any third person till the next date of hearing. The plaintiff is directed to continue depositing the remaining installments (if any) in respect of suit property to the defendant No.1 and in case the defendant No.1 refused to receive the outstanding installments in respect of suit property, the plaintiff shall deposit the same forthwith to the Nazir of this Court. Put off to 25.08.2026 for hearing on application U/O 39 Rule 1 & 2 CPC as well as filing W.S & C.A by the defendants side. |
