Sessions case called. All 06 accused namely 1. Jairaj 2. Mumtaz, 3. Shakoor, 4. Shakaruddin, 5. Haji and 6. Umeruddin are present on bail. Mr. Nadir Hussain Junejo learned DPP on behalf of the state is present. Mr. Dileepsingh learned advocate is present and he has filed his vakalatanama on behalf of all accused. Complainant namely Barkat Ali, injured P.Ws namely Nawab and Rasool Bux are present. Mr. Jeeloji learned advocate is present and filed application U/S 493 Cr.P.C alongwith his vakalatanama on behalf of complainant. Both parties moved joint application U/S 345(2) Cr.P.C at Ex-02. Notice to DPP. Copy of the same is supplied to DPP. DPP has given no objection on both applications. Arguments heard from both side. Order passed on separate sheets at Ex-04 & Ex-05 and announced in open court whereby applications Ex-02 & 03 are allowed and all 06 above named accused are acquitted U/S 345(6) Cr.P.C. They are present on bail their bail bonds stand cancelled and surety discharged.
