On the first call the plaintiff and his counsel were called absent, it was informed that they were on their way, as the plaintiff was coming from Karachi whereas his counsel was coming from Hyderabad. Mr. Muhammad Tariq learned counsel for defendant No.7 was present and expressed his willing ness to proceed with the case, therefore, the matter was kept on aside. On the second call, the plaintiff, in person along with his two witnesses and his counsel, appeared before the Court. Mr. Muhammad Imran Ghouri, learned counsel for defendant No.7, was also present; however, he moved an application for adjournment on behalf of Mr. Muhammad Tariq, contending that due to a sudden health issue he had left the court premises. Mr. Muhammad Imran Ghouri was specifically reminded of the assurance given by him on the last date of hearing to proceed with the case at any cost. However, he submitted that his senior had restrained him from conducting the cross-examination. At this stage, the learned counsel for the plaintiff vehemently opposed any further adjournment, contending that the plaintiff has been regularly attending this Court from Karachi on several dates of hearing, but each time the case is adjourned on one pretext or another, thereby deliberately delaying the proceedings, and prayed for an appropriate order. In view of the facts and circumstances discussed above, I am of the considered view that the present adjournment application moved on behalf of the counsel for defendant No.7 is devoid of substance, particularly when another counsel, Mr. Muhammad Imran Ghouri, has also been engaged separately. His reluctance to proceed with the case despite earlier assurance leads this Court to believe that it is a deliberate attempt to delay the proceedings. It is also pertinent to note that the plaintiff has been attending the Court from Karachi and his counsel from Hyderabad, whereas the counsels for defendant No.7, being local residents, are reluctant to proceed with the case. Therefore, in the attending circumstances, defendant No.7 is hereby debarred from cross-examining the plaintiff and his two witnesses, namely Shah Nawaz and Allah Dino, and their cross-examination is recorded as "nil". Learned counsel for plaintiff filed side close statement at Ex.33. Put off to 26.03.2026 for evidence of the defendants.
