Matter called. Learned counsel for the plaintiff is present. None is present from defendants side. Process through Bailiff returned unserved upon the defendants. Repeat summons upon the defendants through Bailiff, Registered AD & Courier Service. Order passed on separate order sheet. Therefore, the defendants are restrained from cancellation of the unit of plaintiff and or allotting the said unit to any third person till the next date of hearing. The plaintiff is directed to continue depositing the remaining installments (if any) in respect of suit property to the defendant No.1 and in case the defendant No.1 refused to receive the outstanding installments in respect of suit property, the plaintiff shall deposit the same forthwith to the Nazir of this Court. Let the copy of this order be served upon the defendants through the Bailiff. Put off to 31.07.2026 for hearing on application U/O 39 Rule 1 & 2 CPC as well as service upon the defendants through Bailiff, Registered AD & Courier Service. |
