Family Execution Application caleld. The Plaintiff/DH is absent her learned counsel is present, Defendant/JD and his learned counsel is present. The record reveals that the judgment and decree dated 27-03-2024 passed by the learned Family Judge-I, Court Chamber, in Family Suit No.05 of 2024, titled "Mst. Naheed Vs. Ashiq Hussain," was transmitted to this Court for execution and satisfaction of the decree. Learned counsel for Plaintiff/DH has filed an application for recovery of all outstanding amount from the defendant/JD, on which office report regarding the outstanding decretal amount was called for. As per the report submitted by the concerned COC of Court the defendant/JD has deposited only Rs.335,000/- towards satisfaction of the decree, whereas an amount of approximately Rs.380,400/- still remains outstanding against him, subject to exact office calculation and further accruing monthly maintenance. Thereafter a show cause notice was issued to the defendant/JD directing him to either deposit the outstanding decretal amount or furnish a satisfactory explanation. Today, despite being afforded sufficient opportunity, the defendant/JD has neither deposited the outstanding decretal amount nor advanced any lawful or satisfactory cause for his failure to comply with the decree. The decree has attained finality and remains unsatisfied to the extent of the outstanding liability. In these circumstances, this Court is satisfied that the defendant/JD has wilfully failed to satisfy the decree and that coercive process has become necessary to enforce the decree. Accordingly, in exercise of the powers conferred under the relevant provisions of the West Pakistan Family Courts Act, 1964, read with the applicable provisions governing execution of decrees, the defendant/Judgment Debtor is ordered to be detained in the Civil Jail, Shaheed Benazirabad, until satisfaction of the decretal amount or until his release in accordance with law. The In-charge, Court Police, is directed to take the defendant/JD into custody forthwith and hand him over to the Superintendent, Civil Jail, Shaheed Benazirabad, along with a copy of this order, for compliance. The Superintendent, Civil Jail, Shaheed Benazirabad, shall receive the defendant/JD in custody and keep him detained in accordance with law until the decree is satisfied or until further orders of this Court. in the interest of Justice matter is adjourned to 15-07-2026 for compliance. |
