Perusal of the record reveals that the matter is presently fixed for plaintiff side evidence and for orders on two separate applications filed under Order VII Rule 11 C.P.C. It further appears that an application under Order VII Rule 11 C.P.C. was earlier filed by learned counsel for defendants No. 03 and 05, on which notice was issued and objections have already been filed by the plaintiff side. Subsequently, another application under the same provision was filed by learned counsel for defendants No. 01 and 04, which was fixed for hearing on the question of its maintainability. Learned counsel for defendants No. 01 and 04 advanced his arguments on the previous date, and the matter was thereafter fixed for orders on the said issue. However, upon careful consideration, this Court is of the view that it would be just, fair, and proper to decide both applications simultaneously on merits, as they arise out of the same suit and are based upon similar legal grounds. Separate decisions on the two applications may lead to inconsistent findings and unnecessary multiplicity of proceedings. Since objections have already been filed on the earlier application, but no objections have yet been filed on the subsequent application, therefore it will be appropriate to afford an opportunity to the plaintiff side to file objections / counter affidavit to the later application as well, so that both matters may be adjudicated comprehensively. Accordingly, ordered passed on later application as, ?Notice to plaintiff side?. The earlier application under Order VII Rule 11 C.P.C. filed by defendants No. 03 and 05 shall be fixed for re-hearing from both sides on the relevant legal points. The subsequent application under Order VII Rule 11 C.P.C filed by defendants No. 01 and 04 shall be fixed for filing of objections by the plaintiff side. Till the disposal of the aforesaid applications, the matter shall remain fixed on CFMS for hearing of these applications only. The matter shall be fixed for plaintiff side evidence only after disposal of both applications. The Reader of the Court is directed to fix the matter accordingly in the CFMS system.
