The Nazir is further directed to issue cheques to the shareholders/parties as per their names mentioned on their CNICs. It is further clarified that in case of death of any of the shareholder before or after receiving his/her share, his/her surviving legal heirs would be entitled to get their respective share from the Nazir of this Court after submitted proper application along with FRC and death certificate. The instant execution application is disposed-of accordingly. |

Therefore, the defendants/J.Ds are directed to handover physical possession of the suit property to the auction purchaser on or before 30.10.2025. In case of failure to vacate the property by the defendants/J.Ds till 30.10.2025 the Nazir of this court is directed to execute writ of possession with police aid and break opn the locks. The sale in respect of the suit property i.e. House No.108-A, admeasuring 120 sq. yards, Block-F, Cantt. Bazar, Malir Cantonment, Malir, Karachi is hereby confirmed in favour of Auction Purchaser namely Aman Jalal Khan son of Khan Muhammad Jalal. Let the sale certificate in respect of the suit property in terms of Rule 94 of Order XXI CPC be issued in favour of the said Auction Purchaser. Nazir of this Court is directed to take-over possession of the suit property from the defendants/JDs or any other occupant and handover the same to the Auction Purchaser. Nazir is authorized to seek police assistance from the concerned police station, if so required. The sale consideration amount in respect of the suit property shall be distributed amongst the Plaintiffs/DHs and the defendants/JDs per their respective shares in accordance with the law after deducting the unpaid utility bills and unpaid property taxes of the suit property (if any). The Auction Purchaser is required to submit unpaid utility bills and property taxes in respect of the suit property within seven days. The original documents in respect of the suit property are lying with the Nazir which shall be handed over to the auction purchaser. There is no order as to cost. Put off to 18.10.2025 for compliance. |
