The complainant Muhammad Alam, his brother Bhaji, both the brothers of the deceased, injured Haseena Khatoon and Amna Begum, LRs of the deceased, his wife Mst. Marvi, daughters Mst. Amana and Mst. Sonari are in attendance. Application under section 345 (4) Cr.PC is taken up first. Mst. Marvi being the real mother of the minors Gulistan and Irshad is appointed as guardian/Wali to contract compound and enter into compromise on behalf of minor LRs of the deceased, such order is passed on application under section 345(4) Cr.PC. The statement of the complainant, his brother Bhaji, injured PWs and LRs of the deceased is recorded at Exh.29 to Exh.35, in which they have stated that they have patched/compounded the offence with the present accused and have waived right of Qisas, Diyat and Akhw and pardoned the present for the sake of Almighty Allah and raised his no objection for acquittal of the present accused from the charge of this case. They produced their own affidavits, PS copies of CNICs which are taken on record. Application under section 345(2) Cr.PC is then taken up, the same is heard and stands dispose of vide separate sheet at Exh.36. The same is allowed and parties are accorded permission to compound the offences. Application under section 345(6) Cr.PC is taken up and stands dispose of vide separate order on copy of CFMS DC at Exh. 37. Accordingly the application under section 345(6) Cr.PC stand dispose of resultantly, the present accused Jan Muhammad is acquitted on basis of compromise under section 345(6) Cr.PC. he is produced in custody and remanded back to district Jail Shikarpur till further orders. The case against remaining accused be kept on dormant file till their arrest or otherwise.
