Case called. Accused Willayat Choliyani is produced in custody by Jail Authority Central Prison Sukkur. While remaining accused are absconders and already declared as P.Os except accused Khadim Hussain who is shown as expired in the charge sheet/challan. Learned DDPP for the State is present. Judgment also prepared, signed and announced in open court at Ext.26. For the reasons to be recorded. I am convinced to hold that accused namely Wilayat son of Jalaldin @ Sojhro by caste Choliyani, is one of the authors of instant offence of murder. I, therefore, convict him under section 265-H(ii) Cr.P.C for committing?? murder of Maula Bux alias Nadir Choliyani, the same offence being punishable under section 302 (b) PPC is proved against him by the prosecution beyond the shadow of any reasonable doubt. Since there are no mitigating circumstances, therefore, there is no need to take lenient view in awarding punishment to the convict. I resultantly, sentence convict Wilayat son of Jalaldin @ Sojhro by caste Choliyani, to death subject to the confirmation of Honourable High Court of Sindh Circuit Court Larkana. He shall be hanged by his neck till his death. Since convict is sentenced to death, therefore, the ingredients of section 382 (b) Cr.P.C are not attracted to his case. ??The convict is produced before court in custody from Central Prison Sukkur and remanded to same prison along with conviction slip with directions to carry out the above mentioned sentence. Let the copy of this judgment be provided to the convict free of cost. Certified copy of this judgment provided to the convict, free of costs and such receipt obtained from him and kept on record. Office is directed to submit the reference before Honourable High Court of Sindh Circuit Court Larkana, as required under section 374 Cr.P.C.
