Case was taken up at first call learned prosecutor, learned counsel for the complainant and learned defense counsel called absent even the accused are also not present. Case was kept aside for second call at 10:00 AM. Case was taken up again on second call at 10:20 AM however at that time Accused Saddam Mallah is called absent without any intimation, while both the accused Nadir Bhand and Akhtar Ali Bhand are present and the learned prosecutor and learned counsel for the complainant are also present yet the learned defense counsel remained called absent as before, no intimation is received. The learned counsel for the complainant submitted that if the learned defense counsel is present he is ready to call his witnesses. In view of the nonappearance of the learned defense counsel despite the case was called twice the learned defense counsel is given last chance to cross examine the witnesses whose examination in chief were recorded.
