The matter called. Accused Jhangir is called present on bail. DDPP for the state is present. Counsel for the accused is present. The matter in hand pertains to year 2024. Subsequently, the charge in the case was framed by the learned predecessor on 03.10.2024. however, till date prosecution has failed to examine even a single witness though process has been issued for appearance of witnesses. It has been many time noticed and observed by the Court that the investigation branch of police of district west is almost non existence and many cases fixed for evidence go without any progress for years and years. Keeping in view such conduct and before passing any corrective order it is necessary that one last chance be given to the prosecution to produce its witnesses failing thereof, the coercive order shall not only follow against the concerned officials but the matter in hand may also be disposed of by this Court while exercising powers under section 265-K Cr.P.C. in this regard, additional D.I.GP Karachi West Zone is directed to execute BWs in the sum of Rs.20,000/- against each PWs and ensure their appearance on the next date of hearing alongwith police papers and case property. The office is directed to forthwith communicate the order in hand to DIGP west for compliance. To come up on 20.04.2026. |
