Cr.Appeal No. 10 of 2026 under section 498 Cr.PC in respect of the impugned judgment dated 12.09.2024 fixed at Sr. No.3 of CFMS-DC System is taken up in open Court. The counsel for appellant/accused and DDPP for the State are present. On previous date of hearing, it was ordered for calling R&Ps from the trial Court/Civil Judge & J.M-II, Ubauro. The Reader has apprized the Court that such letter has been issued by this office and receiving copy has not been returned from the trial Court. Issue reminder to the trial Court with the direction that no further reminder will be issued by this Court in capacity of exercising appellate jurisdiction, in case, on next date of hearing R&Ps will not receive to this court, this will be treated as misconduct and matter will be sent to worthy MIT-I Principle Seat at Karachi for necessary orders. Meanwhile, query was made from the DDPP for the State whether the State has preferred any appeal against accused for enhancement of punishment of impugned judgment and submit such reply in writing on next date of hearing. The counsel for appellant/accused made request for fixation of the matter on any Wednesday, which is day fixed for him to appear before the Courts at Ghotki. The coming Wednesday will be observed as 12th Rabi-ul-awal and there is much possibility of declaration of holiday and later on Wednesday will fall on 02.09.2026; hence the matter is fixed on 02.09.2026 for hearing.
