06-11-2026. Matter called. It is fixed for hearing on bailiff report. In this regard learned counsel of D.H appeared and advanced his hearing. None appeared from J.D side. Perusal of bailiff report in respect of writ of possession reveals that in compliance of writ of possession, he on dated: 22-10-2026 along with legal heirs of D.H namely Mumtaz and two witnesses went to the suit property, Tapa Khumbri, Taluka Shujjabad for recovery of possession of suit property where J. D No.02 Mohram Ali and others were present who informed to bailiff regarding the writ of possession. The bailiff asked the J.Ds in presence of witnesses to vacant the suit property and deliver the same to the D.Hs through bailiff upon which the J.D Mohram Ali got invite and became ready for fight / quarrel and issued threats of murder and told the bailiff that J.Ds will never the vacant the suit property at any cost. The bailiff has further reported that Devi plants were available at suit property. The bailiff pasted the notice of 24 hours at the suit property at Devi plants in presence of witnesses. He further reported that after expiry of 24 hours, on dated: 23-10-2026, the bailiff along with legal heirs namely Mumtaz of D.H and two witnesses again went to the suit property where J.D Shair Ali, Mohram Ali, Madad Ali and others were available at suit property. The bailiff asked them to vacate the suit property upon which they make hue and cry and became ready for fight and also issued threats of murder. Upon this the bailiff has reported that due to Devi plants, the necessity arises for measurement of suit property through Mukhtiarkar and Tapedar concerned. The bailiff has prayed that heavy / appropriate police aid be also be provided to him. The bailiff has prayed that writ of possession be issued along with Mukhtiarkar and Tapedar, Taluka Shujjabad for measurement of suit property and appropriate police aid be provided to him. Virtue of aforesaid position, it appears that writ of possession could not normally be executed, hence, request of bailiff bears merits for consideration. As such, office is directed to issue letter to concerned Mukhtiarkar and Tapedar for conducting measurement of suit property. Issue letter to S.H.O concerned police station to provide necessary aid to the bailiff for recovery of possession. Let writ of possession be repeated accordingly.
